Transparent licensing of the results of intellectual activity as a driver of open science

Abstract

The article addresses the methods to improve the legal availability of the results of intellectual activity in the Russian Federation, considering the international experience. In particular, the authors studied the licensing activities of the worldwide partner network of the non-profit Creative Commons organization. The article was prepared with the participation of the federal state budgetary educational institution of higher education "The Russian Presidential Academy of National Economy and Public Administration"in implementing the strategicacademicleadership program "Priority2030",approved bythe Government of the Russian Federation.The relevance of the applied approach to the use of open licenses is comprehensible since it ensures the balance of interests of the parties: the rightsholders are interested in observing the protection of their copyright (and associated) rights and increasing their citation rate as authors.The open licensing mechanism allows authors to give the right to use their work to an unlimited number of people on the terms they set out,with the licensees gaining uncomplicated and legal access to the results of intellectual activityfree of charge.Such a transparent open licensing approach could compete with the traditional approach to creating license agreements.
